Subject: CORA Request: Project Silo, Data Center Moratorium, Silver Peaks, Lochbuie/Weld County Communications, Wastewater Capacity and Sewer Board Representation
Pursuant to the Colorado Open Records Act, C.R.S. §§ 24-72-200.1 et seq., I request electronic copies of public records concerning Project Silo / Willard Property, the proposed data-center moratorium, intergovernmental communications concerning the project, and Brighton's wastewater relationship with the Town of Lochbuie.
The requested date range is January 1, 2024 through the date this request is processed, unless a different period is specifically stated below.
1. Project Silo and proposed data-center moratorium
Please provide all drafts, proposed ordinances, resolutions, memoranda, staff reports, legal analyses, presentations, talking points, emails, text messages, meeting notes, calendar entries and other communications concerning any temporary or 90-day moratorium on data-center applications, approvals, permits or development.
Please include records discussing pending applications, grandfathering, vested rights, exemptions, savings clauses, existing applications, complete applications, Project Silo / Willard Property, and whether new data-center regulations would apply to Project Silo.
2. Project Silo grandfathering and vested rights
Please provide all records discussing whether Project Silo has acquired, may acquire, or has been claimed to possess vested development rights, grandfathered status, protected pending-application status, exemption from subsequently adopted regulations, exemption from a data-center moratorium, or any other legal right allowing review or development to continue despite later regulations.
If the City possesses records identifying a legal basis or date upon which any such right allegedly arose, please provide those records.
3. Communications with the Town of Lochbuie
Please provide all communications between the City of Brighton and the Town of Lochbuie, including its elected officials, Town Administrator, planning staff, public works/utilities staff, attorneys, consultants, and members or staff of the Lochbuie Municipal Sewer Board, concerning:
- Project Silo, Silo, Willard Property or the proposed data-center campus;
- WCR 4 / East New Energy Drive;
- North 50th Avenue;
- Silver Peaks;
- residential proximity or residential buffers;
- land-use compatibility;
- public notice or neighborhood notification;
- roads, traffic or construction access;
- water service or water resources;
- wastewater or sewer service;
- wastewater-treatment capacity;
- wastewater expansion plans;
- flow meters or Brighton wastewater flows;
- utility extensions or easements;
- fire and emergency response;
- noise, lighting or generator impacts;
- a data-center moratorium; and
- Project Silo grandfathering, vested rights or pending-application status.
4. Communications with Weld County
Please provide all communications between the City of Brighton and Weld County commissioners, Planning and Development Services, Public Works, Engineering, Emergency Management, county attorneys or other Weld County personnel concerning Project Silo / Willard Property.
Please include communications concerning jurisdiction, parcel boundaries, roads, traffic, WCR 4, North 50th Avenue, utilities, emergency access, land-use impacts, residential proximity, Silver Peaks, data-center regulation, permitting, infrastructure or the proposed data-center moratorium.
5. Silver Peaks residential community
Please provide all City records identifying, discussing, measuring or mapping the distance between Project Silo and existing, approved or planned residences within the Silver Peaks community.
This request specifically includes any record determining whether any Silver Peaks residence, residential lot, park, trail, school-related use or other residential/community facility lies within 1,000 feet of any Project Silo property boundary, proposed data-center building, switching station, substation, generator area, cooling equipment or other project infrastructure.
Please provide GIS maps, parcel maps, buffer maps, setback analyses, notification-radius maps and similar materials.
Please also provide records discussing whether residents of Silver Peaks or the Town of Lochbuie were required to receive notice of any neighborhood meeting, land-use application, public hearing or other proceeding related to Project Silo.
6. Brighton wastewater sent to Lochbuie
Please provide records showing the quantity of wastewater generated by Brighton customers and delivered to the Lochbuie Regional Wastewater Treatment Plant.
Please provide, where available:
- monthly average Brighton wastewater flow;
- monthly maximum Brighton wastewater flow;
- daily flow data;
- annual total gallons;
- Brighton's percentage of total Lochbuie treatment-plant influent;
- measurements from each Brighton-related flow meter or meter station;
- periods for which flow was estimated rather than directly measured;
- discrepancies or disputes concerning flow measurements;
- billing quantities;
- amounts billed to Brighton by Lochbuie for wastewater treatment; and
- any capacity allocation attributable to Brighton.
Please provide these records for January 1, 2024 through the present, preferably in spreadsheet or native electronic format where available.
7. Wastewater capacity and expansion
Please provide records concerning current and projected capacity of the Lochbuie Regional Wastewater Treatment Plant and Brighton's share of or demand upon that capacity.
This includes capacity studies, wastewater-flow projections, expansion studies, engineering reports, rate studies, financial analyses and correspondence concerning:
- the plant's existing capacity;
- supplemental or interim expansion;
- planned long-term expansion;
- Brighton's current and projected wastewater flows;
- Silver Peaks;
- Project Silo;
- other approved or anticipated development;
- allocation of expansion costs between Lochbuie and Brighton; and
- whether Project Silo wastewater demand has been incorporated into any capacity projection.
8. Project Silo wastewater projections
Please provide every Project Silo record showing projected sanitary sewer or wastewater demand, including average daily flow, peak flow, cooling-system discharge, blowdown, process wastewater or other wastewater generation.
Please identify whether those projected flows were included in any analysis provided to Lochbuie or the Lochbuie Municipal Sewer Board.
9. Brighton water consumption
Please provide records showing total City of Brighton potable-water production and customer demand for calendar years 2024, 2025 and 2026 year-to-date, including:
- annual gallons produced;
- annual gallons delivered or billed;
- average daily demand;
- peak daily demand;
- monthly demand;
- available treatment capacity;
- available storage capacity; and
- projected demand through at least 2030.
Please provide these data in spreadsheet/native format if maintained electronically.
10. Appointment of Brighton representatives to the Lochbuie Municipal Sewer Board
Please provide all records concerning the selection, appointment or designation of Brighton representatives and alternates to the Lochbuie Municipal Sewer Board from January 1, 2024 through the present.
This includes resolutions, motions, Council minutes, staff memoranda, emails and correspondence identifying:
- who had authority to appoint Brighton's representatives;
- when each appointment or reassignment occurred;
- Peter Padilla's appointment or designation;
- Chris Fiedler's appointment or designation;
- Tom Green's appointment or designation;
- Melinda Carbajal's appointment or designation;
- the duties expected of Brighton representatives;
- any reason documented for a change in representation; and
- whether wastewater capacity, expansion, Brighton wastewater volumes, Silver Peaks, Project Silo or other development issues were discussed in connection with those appointments.
11. Brighton-Lochbuie wastewater agreements
Please provide the current and historical agreements governing Brighton's use of the Lochbuie Regional Wastewater Treatment Plant, including the First Amended and Restated Beebe Draw Wastewater Service Agreement, amendments, settlement agreements, flow-meter agreements and any subsequent agreements or proposed amendments.
Please also provide correspondence concerning Brighton's rights, capacity allocation, financial obligations and representation on the Lochbuie Municipal Sewer Board.
12. Wastewater disputes, mediation and transition planning
Please provide non-exempt records concerning disputes between Brighton and Lochbuie involving treatment-plant capacity, expansion costs, flow measurement, compliance with wastewater agreements, mediation, or Brighton's consideration of transitioning wastewater service to another treatment provider.
Please provide all reasonably segregable portions of any responsive record if another portion is withheld as privileged or otherwise exempt.
13. Communications with Project Silo representatives
Please provide communications between the City and any Project Silo applicant, owner, developer, consultant, attorney, prospective operator/end user, utility or representative concerning Lochbuie, Weld County, Silver Peaks, water, sewer, wastewater capacity, infrastructure, moratoriums, grandfathering or vested rights.

If records responsive to this request are maintained by multiple City departments, please coordinate the search or identify the appropriate custodian.
If the anticipated cost will exceed $25, please provide a written cost estimate before incurring the expense.
