Alternative-site analysis follow-up
Mayor Mills and Members of Brighton City Council,
This is a follow-up to the questions previously submitted regarding Project Silo / the Willard Property data-center proposal.
The additional issue is site selection: why was this location selected, and what alternative locations were evaluated before a large data-center campus was proposed near existing and developing residential areas?
Please identify whether an alternative-site analysis was conducted; every site or general area considered; the scoring criteria; who selected the Willard / WCR 4 property; whether Brighton Economic Development presented alternatives; and the reasons any alternative was rejected.
Please identify the criteria used for residential separation, schools, road capacity, heavy-haul access, transmission access, electrical capacity, fiber diversity, water, wastewater, fire protection, drainage, noise, lighting, generator emissions and public infrastructure costs.
Please also identify the total infrastructure cost attributable to the WCR 4 site and which costs would be borne by the developer versus Brighton, Lochbuie, Weld County, utilities, ratepayers or taxpayers.
We request a comparative site analysis using the same criteria for the WCR 4 property and reasonable Brighton industrial/employment alternatives.
Please preserve all correspondence, meeting records, presentations, site-selection materials, scoring documents, economic-development communications and communications with the applicant or prospective end user concerning alternative locations for Project Silo.

Moratorium / grandfathering follow-up
Mayor Mills, Mayor Pro Tem Padilla, and Members of Brighton City Council,
I am writing regarding the 90-day data-center moratorium Mayor Pro Tem Peter Padilla has said he intends to propose at the October 6 City Council meeting.
The central question is: Will Project Silo be subject to the proposed moratorium, or will it be exempted, vested, grandfathered, or otherwise permitted to continue because an application has already been submitted?
Please provide written answers addressing whether the moratorium will apply to pending applications; whether Project Silo is considered vested, grandfathered or exempt; the legal basis and date of any claimed vested right; which Project Silo applications or reviews would pause or continue; whether regulations adopted during the moratorium would apply to Project Silo; whether the ordinance will contain a savings, grandfathering, vested-rights or pending-application exception; and whether the applicant or its representatives have requested any exemption.
If the City believes Project Silo has obtained any vested development right, please identify the specific approval, ordinance, statute, agreement or other legal basis creating that right and the date the right was established.
Please make the draft moratorium ordinance, including definitions, exemptions, grandfathering language and applicability provisions, available to the public with sufficient time for review before Council acts.
